Have I got a claim

Here goes,
Earlier this year (26th February) I purchased a 2nd Hand engine for my VW Golf from a breakers yard, in the midlands, which I had found on ebay.
I made the purchase away from ebay and paid on my Natwest Mastercard (£384.00). The engine was delivered the next day and on inspection a few parts were damaged. (Throttle body, exhaust manifold etc nothing that was included in the sale or that couldnt be replaced with parts from my engine).
Having fitted a new cam belt (£108.00) oil filters, plugs etc (£60.00), new clutch (£96.00), and fitted the engine my mechanic found the cam cover was cracked, we removed it only to find 3 of the bolts holding it on were sheared off in the head. We phoned the supplier who was totally dismissive and told us since we had removed it the warranty was void, even suggesting he should have fitted the engine and worried about it if I complained!!!!!
We pressed on and had the bolts drilled out and re tapped (£60.00) and fitted the engine, turned the key and found it wouldnt idle, 1 new throttle body later (£45.00) and it idle but makes a horrible noise when starting, 1 reconditioned starter motor (£42.00) and were ready to go.
Labour Charge = £250.00 Total spent £1045.00 plus a few other parts not related to the engine,
At long last this weekend having scraped together the insurance & tax money we took it for a spin Saturday morning, for 17 miles (1/2 hour) it was great, until it made a horrible grinding noise and started sounding like a tractor when under 2000 revs. Headed straight back to the garage but the car didn't make it.
The Garage recovered it this morning and have done some investigation free of charge, the general concensus is that its bottom end damage. Neither me or the garage have done anything to the bottom end we suspect that when the cam cover was damaged a piece of the cover may have become loose in the engine and has caused the problem. Everyone who has seen it seems to think the engine has been dropped at some point before it was delivered, the breakers who supplied it are totally unhelpfull and hung up on my mechanic when he asked them not to continually interupt him.

Anyway long story short - is this something I could claim for under section 75 from the Creditcard company?

    Who did you pay using your card? PayPal or the Merchant directly?

    The problem with eBay is that you normally use PayPal and so you effectively lose section 75 protection.

    Why not use the normal eBay/PayPal dispute process?

    If it was paypal you should have used them, the problem is you should have inspected the engine and once it "wasn't as discribed" in the advertisment you should have contacted the seller leading to dispute action. Since you have done alot of work to the Engine yourself I would say there is very little you can do. Thsi is a chance you take with breakers yards the old line "you bought it how you say it". You could always try the small claims court but again its your word against the seller and since you have done a lot of work yourself the seller can simply say you caused the damage.

    I believe the OP tried this at first and was fobbed off by the breakers yard.
