Self Employed and DRO

Can you be self employed and have a DRO? It says something about not being a company director but running a little business for yourself, is that ok? Income will be well below the tax threshold I would have thought!

If your income goes above the £50 surplus during the year DRO what happens then?

At the end of the year, if your income is more than £50 surplus, what happens then?

Is it best to do the DRO before registering as self employed or after?

Can you include a debt that isnt on your credit file? We requested my husbands £2 report from Experian and 2 payday loans are not on there but would need to be included.

We've done the CCCS debt remedy but they've not been very helpful. We had lots of questions and had a call back but the lady just kept saying we had to just fill in the form and they would send us some info which we have received. Maybe we should try and see someone at the CAB as just filling in forms is quite scary as we dont feel confident that something so important is being done right!

Its my husbands debt and the companies don't have our new address, he's very nervous to contact them to ask for an up-to-date balance as he's worried debt collectors will be banging on the door, is this true? 2 of the debts are payday loans.

    Hi Sunny Bear.

    You can do a DRO if you are self employed, we’d work out your income from your previous year’s accounts, it can be tricky if your income fluctuates a lot and this could lead to a DRO being revoked. If a DRO isn’t best advice for you we can look at other solutions.

    You can include debts that aren’t on your credit file. We would need up to date balances so your husband would need to contact his creditors for these. Creditors can sometimes threaten door step collectors but these are not court bailiffs and have no more power than someone calling you on the phone. They are also rarely used. If any CCJs are listed on his credit file regards these debts I recommend he should call us for advice before speaking to the companies.

    Rather than asking the CAB to help you fill out the CCCS forms, why not ask if you can see a CAB intermediary. You can then ask your questions face-to-face and the Intermediary will probably be happy to approach that company for an up-to-date balance.

    An Intermediary can advise you not to proceed with a DRO if they don't feel it's your best option but cannot refuse to submit an application if you insist (might not be the smartest move though)

    To make this clear - you MUST include all your debts.
