    So If I fill in a county court claim form that is thrown out by the court I can tell everyone "I sued you "

    plus if you say "they cannot sue" most people will rightly take that to mean that they cannot instigate court action

    Right, my worries is that a baliff turns up. I do not want the stress. They have sent me 3 sheets of paper with Orange Guernsey on it. It shows months, years, invoice number and amounts. There is no breakdown of how they came to said amounts. Surely if we went to court they would have to provide a more detailed breakdown which is what I have asked them for numerous times.

    I spoke to 3rd party solicitor regulation authority. They told me to write a letter of complaint to Bryan Carter themselves then if I have no luck to go back to them.

    This will be the 6th letter asking for the same breakdown. Its driving me mad. If they take me to court can they do it with such little information? Thanks

    They won't take you to court!

    I suspect it is SB and they are just trying to get the money out of you.

    A. Have you admitted the debt
    B. Has any money been paid in the last six years.

    If you answer no to both the above send a standard SB letter to them end of problem.

    If there has been no payment for over 6 years then it's almost certainly statute barred.

    they can't send bailiff's without a court order AFTER they have been successful in getting a CCJ. If you don't have a CCJ then don't worry about bailiffs.

    Does the debt show on your husbands credit files with Experian, Equifax and call credit? His files can be had for £2 at Experian and Equifax and for Call Credit use Noddle.co.uk which is free.

    I have not admitted to anything in writing. After a grilling today I did say that he might owe them monies as at the time of the account he was ill. Not sure if they record their telephone calls. I thought that if they did, they were legally required to tell you that calls are recorded.

    and no he has not paid a penny since 2005.

    Can I send a standard SB letter and if so where can I get one.

    Will check tom, last time we looked there was nothing on there. Plus all his bills were sent to a c/o address. Nothing was sent to our old home address. He paid his old accountants and everything was sent c/o to their address.
