Dress with no size on it dosent fit?

I bought a dress which was a size bigger than I normally take so I was fairly confident that it would be OK, however when the dress arrived there was labels but they had bene cut so no size could be seen. The seller was selling because it didnt fit her and when I question this said she had bought it on e-bay and was selling because it didnt fit her (too small!) and she was telling me it was that size because the person she bought it off said it was that size.

I have requested a refund but she wont give one, what else can I do, I would feel bad re-selling it at the size she did because it obv isnt that size but a different size wont get as good a price.

Any ideas as to what I can do, can I claim my money back as there is no way she could tell it was that size?

Did you pay using paypal? If so, send it back to the seller via recorded delivery and claim through paypal as significantly not as described (i.e. not the size she said it was).

Measure the dress, find the standard size for that measurement if there is a descrepency then contact her and say that you are willing to offer her one more chance to be reasonable before you go to dispute. State a date for this to be resolved by and open a dispute if they haven't responded by that date. When returning the item make sure you send recorded delivery so that you can prove it has been returned.

Thanks, never thought to measure it!! will do so in the morning, depending on the measurment I may be in the gym in the afternoon!
