PPI claim with Peugeot Finance

Good morning!

I wondered if someone can explain something to me please.

My partner had a finance loan on a car with Peugeot about 10years ago. He was a builder at the time and self employed and they sold him PPI at the time as they said he wouldnt get finance without it. With all the recent media hype surrounding PPI we remebered about this loan, found the paperwork and wrote a letter to the finance company. They passed us to Santander who then passed us onto the Finance & Leasing Association. The FLA have come back today saying "the sale is barred under the Limitation Act 1980...and they have the right to reject a complaint without consideration if the complaint falls outside the set time limits"

Can someone knowledgable on here please explain this Act as not familiar with it and do not know whether its worth taking this to FOS? We had a successful PPI claim with a Santander loan last month which was taken out 9 years ago so why was this not rejected on the basis of a time limit?

Confused!

    Your complaint needs to go to whoever sold you the policy (normally the car dealership in these cases).


    The situation with Santander is that it steps into the shoes of certain lenders/intermediaries it has taken over but then deals with the complaint as if it was that organisation.

    If the original business was covered by FOS or the Banking/Building Societies/Insurance Ombudsman or FOS at the time then FOS has jurisdiction. Otherwise it does not.
