I received a second letter after my confirmation letter which said when my payments will start. Payments are usually made every 4 weeks and put into the bank account specified on the DLA application form.
Does the confirmation letter say when DLA has been awarded from? If not, this information should be in the payment letter.
DLA is normally backdated to the day they received your application and you receive a lump sum of backdated pay then your regular payments start.0 -

can she ask for backdated her DLA due her illness.i mean she's been on ESA nearly 2 years now,she has been told (by a friend) that you may be entitle to DLA but due to her illness either she has't been able to do it or complitly forgot (she use to have social worker and charity but they never mention any thing about DLA ),so can she ask for DLA to be backdated or ask for a lum sum is it adviceable to see a lowyer(i think the lowyer would be free for her)
many thanks for any advise0 -

I think (please someone correct me if I'm wrong) that DLA can only be back dated to when the claim for it was first put in if the claim was delayed for any reason. It can't be back dated the two years she didn't put in a claim for it.I SUPPORT CAT RESCUE! Visit Cat Chat to support cat rescue too.

Hi, i'm pretty sure you can only claim back dated DLA, which they would pay in a lump sum, from the date they received your claim. If there was a delay in your claim for example or a rejection and then you won an appeal you could get it back dated. But only to the date your claim was made; ie when you filled in and sent off the forms. I don't think a lawyer will be able to offer you any help or different advice.I SUPPORT CAT RESCUE! DLA. Will be backdated from the date they received the claim form. So, if you sent the claim form two months ago, you will have two months backpay.
Look on the letter to see when DLA is awarded FROM - it will show a date, that is where they will backdate it from.
You will struggle to get it backdated further. in my recent award they increased my care award, and the letter states they cannot backdate to a date previous to the renewal form as it was my fault for not reporting a change in circumstances sooner.
Had I done so, I would have had increased payments much sooner but the last thing on my mind was getting reassessed for more care when a renewal was due in three years anyway.
They did however, change the date, backdating the date to when they received the renewal form, and awarded indefinitely.“How people treat you becomes their karma; how you react becomes yours.”0
