You need legal advice on this as you probably have a claim whereby you can get your money back at least. It is not my field so I cant advise you myself. Many firms will advise on a no win no fee basis so it shouldnt cost you anything.

As for the chips aspect and paying for them......often "all inclusive" will actually be limited to a set menu/local drinks (as opposed to smirnoff, martell - brand names) or even be limited to certain restaurants/bars.

we paid for it with debit card, chose the hotel online but booked over the phone through the operator, we don't drink so didn't really care about the alcohol issue, it is a member of abta, will go through the documentation,

I think that's seriously jumping the gun there. I am presuming "legal lady'" means that you are a first year law student or a legal secretary.

it was a package holiday? - we chose the hotel over the internet after reading its facilities on the lowcost holidays website and then contacted low costholidays.com to confirm the flights and transfers. spoke to them on the phone and they mentioned nothing about hotel facilities not being open or the season not starting yet so things may still be shut..0 -

It is very important that you read all the paperwork from the agent to make sure that it was actually sold as a package holiday. If this is the case, you are protected under the The Package Travel, Package Holidays and Package Tours Regulations 1992.
However, if they are are trying to use the "dynamic package" excuse, you need to make absolutely sure that at least two elements were booked together and supplied by the same provider for a period of up to twenty-four hours.

i'll have to look intomy emails to get the paperwork as it was all sent through email which we printede out - the flights and hotel and transfers were all booked together at the same time through lowcost holidays.com thew flights were thomas cook - does that matter? nothignwas changed at all the only thing i can think of is that when we rang to confirm the flights they werent comming up on their dsystem and was told that a staff member will get incontact with us and confirm the flights - other than that flights hotel and transfers were from all from lowcostholidays.com so thats a package holiday?0 -

That doesn't necessarily make it a package. If the individual items were from different suppliers or operators, it might not be a package. I could go to a travel agent and book a hotel with The Place Hotel, flights with British Airways, a hire car with Budget and transfers with ABC Taxis, that unfortunately will not make it a package, unless the hotel and taxi company invoice me together, or the car and flights was booked via Thompson Holidays, I think you might struggle to prove it was package holiday.
