Hi all.
The DVLA have revoked my driving licence due to disability under Section 93 and 94 of The Road Traffic Act 1988.
I was hoping to apply for a bus pass but according to my LA's website I can only apply if refused a licence under Section 92 . I'm a tad confused. Can anyone shed some independent advice?

I suggest you apply anyway, and that the council website is inaccurate.
92 applies if when you apply for your licence, it's turned down.
93/94 applies if you have to notify the DVLA that you're unfit to drive.
(on a quick skim of the legislation).
Both have the same outcome - you can't drive.
You could in principle ask the DVLA if a new licence would be refused under s.92 - if the council decides to be annoying.0 -
All LA's have discretion under 'exceptional criteria' so ask the question by submitting an application, whilst on paper you may not be permitted under one or more sections of the '88 RTA you may / may not / be successful.
For example failure to notify the DVLA of (1) a worsening condition is wrong .. .. but not as wrong as (2) making a false declaration as to physical fitness or on the grounds of (3) persistent misuse of drugs or alcohol. - so there is latitude for discretion in (1) but not in (2) or (3).Disclaimer : Everything I write on this forum is my opinion. I try to be an even-handed poster and accept that you at times may not agree with these opinions or how I choose to express them, this is not my problem.
