Where do I stand - Gym accidentally stopped DD and now want 4 month payments asap?

Hi

Just wondering if anyone can shed any light on this?

We have a joint membership with the local council run gym ... it's just been taken over by a private company which on handover accidentally cancelled around 200 peoples direct debits for gym membership payment.

We were unaware that they hadn't taken 4 months payments out and now they are asking for the 4 months payment by the end of May ... we don't have this available as at the end of each month any leftover money in our account automatically overpays our mortgage with the bank!

Do they have the right to ask for it all in one go?

    I would ask what contract you have with this new company.
    Not the moralistic view, but this is a money saving forum...

    They have a right to ask for it as you have used the service.

    However, you could argue with them that you can't afford to pay it in one go, but would consider a monthly repayment.

    I woukd presume that as they have used the gym and therefore accepted the offer of a contract with them.
    The OP may have a case if they hadn't used the gym.

    As you have used the facilities you will be liable. However as they have made the mistake not to take the DD, I agree with Gromitt, it would be fair to pay in installments rather than the 4 months in one go.

    The gym will still almost certainly still be owned by the local authority, but now operated on their behalf with another company. Your contact will remain unchanged.

    If the gym has been sold there is likely to be provision provided within the contract for the contact to be assigned to another party at the company's will.

    Perhaps pay double for the next 4 months, that seems fair enough,

    After all the money that went to the mortgage makes your mortgage less, so you wont be any worse off
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    Can you not pay as much on you mortgage this month to pay off the gym?
    To be honest if it was me I would know that the gym payment had not been made - I think you want to not to pay - imo this will not happen.

    I can't add to what has already been said about your actual query, but I would strongly suggest that you start putting some money into a savings account each month rather than using all 'spare' money to overpay your mortgage. If you don't, any unexpected costs (car repair, dental bill etc) are just going to keep causing you problems like this.

    I think that's a rather misguided assumption??

    If you had been sensible enough to read the question carefully .. I did not say - Do I have to pay? I actually said ...Do I have to pay all in one go?

    And I'm so glad that if it were you that you'd have noticed! It really makes me laugh how people like to take the 'high moral ground' on this website ... wanting to appear to others that they are better than them!

    Well I pay my bills on time and would notice if a bill suddenly stopped without reason.
    The only people who can tell you whether you can pay in instalments is the gym - so when you come down off your cloud please ask them!

    If you really had not noticed that a bill had not been paid in 4 months I would start to worry - what other payments have you missed?
