Appealing Atos Medical--Assessment Rate

Options
Hi,

Was wondering if any of you kind people could give me some advice regarding an Atos/DWP medical appeal.

I had a medical approx 8 months ago and was put in support group. Then was reassessed again on 1st May 2012 and got letter today stating I had been changed to the WRAG group. My illness/disability is exactly the same as it was for my first medical 8 months ago but for some reason this time I was moved to the different group. I got no reasons for this nor have i seen medical report.

I have heard that the assessment rate during the appeal process is £50p/w whilst waiting on appeal/decision. Does this mean that during that period I am only entitled to £50pw if the outcome is staying in the WRAG or winning and going back to Support Group or would DWP have to pay my full benefits owed which I did not get whilst on assessment rate????

Thanks for taking the time to read and I hope someone can help me out. Thank you!!!

As you have been placed in the WRAG, you will get the amount of money applicable to this group rather than the assessment rate (which is paid when people are appealing against a refusal of ESA). If you are placed back into the support group then you will get backpay (eventually).

jcrh youseem to have had the same result as me. was previously in support group but bt some miracle im not as bad this time lol. wish someone would tell my body that. i oo will be asking for appeal, but also just a reconsideration before that so it gets the opportunity of being looked at twice more before appeal.
i had the decision maker ring me on thur to initially tell me i had scores zero points , but with info i gave her ie pointing out varioue "errors"made in what he said she went off to look again and put me in wrag. i think she 0ossibly suspected that was the case as iv had 3 medicals previous to this one and always qualified.
