    In theory, yes. If the phone is being held whilst driving, or any buttons are pushed, it is being "used" regardless of whether a call is actually being made.

    He does not need a seatbelt on in a stationary vehicle, I presume the officer was not clinging on the wipers.

    Nor could he be fined for using a mobile while stationary, plus the OP says the driver "was stopped" as in "pulled over by the police".

    My thought is: does that mean one can't glance at one's watch while driving either? Or pick up a watch off the dashboard or passenger seat and look at it? I know, I know, driving without due caution (taking one's eyes off the road). :D

    I believe to use a hand-held legally, the car must not only be stopped, but the engine switched off......

    So he broke the law two differenet ways not wearing a seat belt while driving and using a mobile while driving. The maxium I think he can get is six points. Has he got a clean license
