Faults not picked up by surveyor

I had a full house buyers structural survey conducted prior to the purchase of a ground floor maisonette.
I have spotted that there is foliage growing from within a rain water pipe, and this should have been picked up in the report (as it has damaged the down pipe). The photo shows the bare branch pointing out from the side of the house but as the photo is taken from a distance you cannot see where from
Within the report the surveyor said the side was cluttered, however he would have needed to walk past the drain to investigate the damp course at the rear of the property. As a surveyor I am pretty sure that his company become liable for any issues not picked up. Does anyone know the best way to solve this issue (as house insurance say it is not covered as it is an issue from before the policy started) and what process do I need to take?
Thanks in advance and please let me know if my insurers are liable (More than) as they told me I am not covered!

I believe More than are correct because it was pre inception, so basically before you paid for the insurance.
Insurance covers you for the period of cover and for insurable events.
I have no idea whether the surveyor would be liable as I don't know a lot about it.

Your insurer will be correct if this happened prior to you exchanging contracts. (Assuming that was when they started to cover the property)
Get your solicitor to advise on this, and to take it up with your surveyor.0 -
