penalty charge notice

H all,
recently I have received a PCN as I stopped 'cause my car brokedown.
I managed, when the car stopped,to drive the car at the entrance of a school and not on the pavement.I stayed with engine off for few min and the hazard light on ...I tried to restart and was not working , after few other attempts it worked again and could leave. I went straight to the mechanic. During that breakdown a traffic enforcement camera/car filmed it and a PCN was sent. They refused my initial representation. I did an appeal based on a mitigating circumstance. A bona fide breakdown backed by the mechanic letter of me been there just after the fault. I believe the appeal did not consider at all the bona fide break down and also it consider the alleyway in to the school where I could stop as pavement continuation. this is crazy. is there a possibility to appeal against the appeal? the fine is £130 now and cannot pay it . I asked to pay by installment as no money in the bank , if they refuse the installment option is there any other way or support I could get. What is the risk there? cheers!

    You do have other options but you need to go to the council parking section at www.pepipoo.com. They can advise you if you would have a chance with taking this to the adjudicator or not.

    All that's happened is to be expected because the truth is that most Councils turn down most informal appeals - because they can and cos they want your money. It's a template fob off rejection letter with a few details added to make it almost make you think they read your appeal...

    But they didn't, and also what they don't tell you is that most people who appeal further, WIN!

    Of course you must carry on with the appeal, the amount will NOT increase now and you should win this if you word it right and go to adjudication (not Court, by the way!). I assume you haven't got that far yet? You must!

    You will need to show pics or scans of all letters received, all pages, and a copy&paste of what you said in your appeal. The posters there can then help you with advice to add weight to your appeal now to an adjudicator (and the car's owner must go to the hearing in person for the best chance of winning. Do not rely on a postal appeal as you need to show the adjudicator that you are a genuine honest person whose car broke down temporarily).

    I hope you kept the originals of your receipt/mechanic's letter? You will need it for adjudication.

    That's a Report from the Chief Adjudicator. There is lots of scope to appeal when you get a sneaky camera PCN (in fact any Council PCN should be appealed).
