Taken to court - non payment council tax

Have the council put this in writing? If I were you I'd be paying a visit to my CAB asap.0

They are now looking to get a Liability Order and I intend to go to court taking the evidence with me.
As I've posted above the court cannot consider this, the only people who could look at your information would be any council tax staff who attend the court to deal with queries - bear in mind those that these staff likely have very little knowledge of council tax benefit as its not their area of work in most cases. They have suggested that I give them written authority for them to approach the DWP to verify my evidence (which actually are letters that I received from the DWP!)
I have refused to co-operate.
In which case you are making it difficult for yourself - they hold all the cards so have the (legal) upper hand in this.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
To ask me to give up my rights under the Data Protection laws and allow the Council to obtain whatever they want from any DWP source is one step too far.
They should have there own ways of confirming benefit details without asking that of me.
They can check information with DWP but they can only use what DWP provide - if this is wrong then the council can still only act on what is given.
By asking you for your permission they appear to be trying to help you by discussing the matter with DWP to try and resolve the problems.I know what has happened and the DWP are at fault in giving out false or inaccurate information to the council. But is that my responsibility to sort out or should it not be between the DWP and them?
The council are under no duty to correct or attempt to correct information supplied to them. They act on the information they have, any inaccuracies are between you and DWP to sort out - the council have no duty to correct or attempt to correct information held by a 3rd party and which was not provided by the council.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. I'm more than happy with what the DWP have confirmed to me. The benefits I am on and the amounts, as well as other DWP documentation that confirms my status perfectly.
It's the info that the DWP have sent to the Council that is up the creek and does not agree with the info the DWP have sent me.
The council will not accept the letters I have received as evidence so are going on their own sweet way of calculating our income at a level that is well over £100 a week more than what we actually receive.
I have created the doubt as to the accuracy of their figures with evidence, but they are choosing to ignore it.

Thank you and very interesting. Though that is not a posting of mine is it, so why suggest that it is?
We are all so used to you and your AE's andy, dont insult us by fake ignorance of who you really are as usual because it dosnt wash and we all know you will admit anyway.
You are a joke, a very bad one but at least you give us the chance to laugh at you as much as we did your first account as andyandflo. I really laughed at "Paula" finding you dead!!!0 -
Had 2 letters today.
One telling me I have been awarded full housing and council tax benefit.
And backdated.
the second is telling me I owe £100 court costs
Can I appeal this? I was told it was there fault it got this far, because the council were behind!
And I contacted the council every time I had to and did as I was told over the phone (take in proof etc)0 -

Legally the council do not have to hold action for any benefit claims however most councils will look again action taken if another council dept was responsible for the delay.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. Me again.
I was told it would sort itself out (benefits and court)
I received a letter, telling me I have full council and housing benefit, backdated. Great!
Now I have a liability order and a form, asking me for my details, so the £100 can be taken from my benefits!
I have just rung up and the lady on the phone said I must fill in the form and return it, and when it's sorted, the money I owe (which I shouldn't, as it is there fault. they were behind processing my claim)
will be wiped out!
I then pointed out that this was just for court costs, which I should owe.
She ummed and said fill it in and wouldn't say if I had to pay it or not.
I'm trying to get through to CAB, to get help.
Can anyone please advise if I will have to pay the court costs, even though it's not my fault and twice I have been told not to worry.
If it was my fault, I would hold my hands up and pay it. I'd feel bad and accept it.
But it's not right that I did everything I was told and still they take me to court (because they are behind, I was told in the council it is there fault)
And thank you again for any help0
