I found this website a little over two weks ago. I was searching for some legal advice on a couple of problems i currently have and this site popped up.
First the quick bit. I have used the Mr Lewis' system to check the council tax band of myself and my mother in law who lives nearby and both the sytems methods for checking show we should be in band B and not C. I have been in my property for 6 years and the mother in law has been in hers since about 1993. So if all goes well we both could be in line for decent rebates.
Also, since about the year 2000 i have had several credit cards that have charged me loads and it looks like I can get a fair wack there. So can my mum and my mum-in-law.
The 1st of my two big problems (or not if I get a decent pay out)
In Feb last year the royal bank of scotland said they would add our 2K overdraft to our existing loan which stood at around 4K. We waited for the paperwork to arrive but it didn't so after about 2 weeks we phoned them. The girl who originally dealt with it had gone on holiday and not told anybody about our arrangement (she went to India for 6 weeks). They said they would send more paperwork. That never arrived. We got the FOURTH lot. By this time charges had started to be applied to our now exceeded overdraft. They continued to mess around and by about June i'd had enough and made an official complaint. They ended up offering to refund all the charges (£1080) and give us £250 as a good will gesture. As a quantity surveyor I found it easy to calculate that approximately 25 phonecalls each over 9 months or so, especially towards the end, came to well over a grand, thats the 15 minute per call at £1.50 per min for the network charges and £25 per hour for my time to make those calls
I also wanted returning to the status I was at before their errors and they said "OK but, the new loan would now have to be at a higher rate than the original one as my credit rating was not as good as it was then". As you might expect I took it to the Ombudsman. The only thing he really acheived was to get the bank to return us to the same status we were at before with cards and full facilities etc. I also asked him to get them to remove any credit crap they had put on over this and they assured him they had removed it. I signed the acceptance of the offer but I then heard that they first wanted to see my wages go in regularly before they give us cards. This for me was the last straw and I said to the Ombudsman to tell them to forget it which he did. I then searched the net for legal advice and found the fantastic Mr Martin Lewis I looked at his article about reclaiming bank charges and realised my only option left was the small claims court. So 12 days ago I put a claim in for 5K as I can account for more than that, but the article says the small claims limit is 5K. I've not heard a thing yet and am waiting till monday at midnight and hopefully start judgment. But it does not end there. I have been getting refused credit since well before xmas andwas not sure why. 2 days ago I used Mr Lewis' skills again to get mine and my wife's credit files. My wifes has a massive red section from the royal bank. they were putting the bad marks on hers all along. I am also about to sign for a re-mortgage and have been offered only a credit repair mortgage. it is 6 % and I have seen that it is possible to get one for as low as 3%. I calculated that the difference between the overall total repayments on a 6% and a 4% mortgage of 145K is just over 50K. So I have told the FSA and they are getting their team to deal with the RBS, though he said they wont tell me what happens when they investigate the whole saga. I also told the Information Commission Officer who deals with Data Protection Act enforcement. He said it sounds like they have broken Data Protection rules and their team is going to contact me.
Bearing in mind the figures I have just given, does any body know what I should be asking for,eg more or less. Im writing them a letter in the morning.

I bought a pc off Dell in September 06. I paid 10%(£85) and set up a DD for £24 per month. Two weeks later they took £148 out of my account. 3 weeks later they took £70. A month later they took £188. then £196 then £34 a month for December Jan and Feb.Two weeksago I gets a letter off a company saying I have not paid Dell since the deposit and I owe £850 End of October I phoned them to see what was going on. They were completly useless and did not now what day it was. She had all my details except the bank account number was not mine. She was adamant it was though and hey, she should know my bank details more than I do (NOT). January 2nd I sent a letter of complaint to their offices in Ireland. I got no reply and the first talking we did on the phone was after I got the letter from these debt recovery people. First of all it was 10 minutes waiting for an asian to not be able to understand me, nor me him. Then I got a bit better understanding (and I mean a bit) when I got to an Office in Ireland. 3 out the 4 I spoke to were Polish the other Irish. I sent them my internet bank statements which get downlaoded as a spreadsheet. They would not accept them as apparently I could have fabricated the very long numbers next to each dell transaction (which surely must relate to their account). I said "I don't have to prove myself to you after you ignore my official letter of complaint. I am still waiting for a reply to it. "You should check your own bank statements". I then got in touch with the company who runs and owns the Direct Debit scheme, They are called BACS and do bank transfers and wages and things like that. They too are getting a team on to the case and I intend to asses the credit damage done by Dell and blame them for the "Credit Repair Mortgage".
If anyone has read this far then thank you very much indeed. If any of you are experts and would like to advise me i would be extremely grateful.
Im writing another letter to the bank telling them that I intend to claim more from them and to remove the erroneous details from the credit file straight away. The I.C.O. wants me to send him a copy with my ICO complaint form at the same time. I am thinking that if There is ICO action and FSA action (privately) then that has to help my case for being forced to pay an extra 50 grand over the next 25 years.
When all these troubles are finished I will be able to give a grand total but I will put my "awards" up as they come in, 4 credit cards, council tax, the possible 5K on tuesday when the 1st deadline on small claims is reached.
Any advice on Dell please. can I blame them for the big mortgage I'm blaming the bank for it but I think both have contributed..

up until finding this site I have been banging my head against a brick wall. I've been trying to better myself by going to university and in that time we as a young family have struggled like mad with no help from any orgs or from government. In fact sometimes it felt like the big orgs I have dealings with were just waiting for me to slip up so they could take my house. But now my wages have increased and we made it through but this site is DIFINITELY going to get me my revenge.

Nice to read a success story I'm glad you're getting back what you deserve.
In relation to Dell, sorry you've had such poor treatment I like this company and have found the customer service good ( I am not an employee ).
When my 26" monitor went fizz last year they swapped it within 24hrs for the latest 32" at no charge.

It is an American site but if you post details of your problem the administrators are Dell employees, they don't like bad news on the Forum and I am aware that in many UK cases have directed the issue across the pond and people have been assigned specific Dell staff to resolve the issue.
This is just what happened with the monitor problems, to limit bad press we got the all singing upgrade.

Well thanks very much for that mjr600, I shall get on it either tonight or in the morning. As I said, I now have the BACS team sorting it out but maybe your idea will give the case a bigger profile internally and also become knowledge to alot of others which as you say, they wont like. It could all lead to a bigger gesture of goodwill, should they decide to make one. I dont think Dell have reported bad on my credit file as yet so I will probably not bother too much about pursuing a claim with them as long as they get it sorted and say a big soooory. I am very happy with the pc. Maybe they'll offer me an upgrade or something for all the hassles. I'l let ya know anyway of any outcomes. Hopefully it won't be too long a wait.

Ps I used the confused.com end of Feb and got swiftcover, fully comp for £240. My old insurer Zurich said £560 to carry on my existing. They gave me a net quote of £420. 15 years driving no accidents or claims. The big companies with lots of advertising and customers have been overcharging us all for years. This competition element to the market shows that up now.
