Stolen car has turned up after four months

    Ist thing ask Tesco's to provide copies or trans-scripts of the telephone calls.

    She also needs to contact the finance company and let them know the whole situation.- She made a mistake not to continue to pay the payments buy hey hindsight is a wonderful thing. Legally she is responsible for the payments and any shortfall.

    The problem is that sounds like she did not have confirmation of Tesco;s writing the car off. That said insurance companies are regulated and have specific time frames in which to take certain types of action. They will have codes of practise that they have to adhere to.

    4 months sounds excessive. You need the telephone calls she made to Tesco's. You also need read and re-read their standard levels.

    If you feel that they have broken these codes of practise you may be able to refer the matter to the financial ombudsman.http://www.financial-ombudsman.org.uk/

    Ok, so the story still isnt making sense.....

    Car stolen 14 days ago, in that time the current finance company is taking her to court for non-payment? She would have needed to have defaulted before the car was stolen for that to be happening. Are you sure the theft wasnt arranged if she is having financial difficulties?

    In 14 days she has also gone out and bought a new car on finance despite her seeming financial difficulties on the first car?

    Lets ignore all the inconsistencies of the stories. Until the vehicle is total lossed it remains her property. 14 days is not a long time at all in either police nor insurance timescales. As it has been recovered with only minor damage the insurers are perfectly entitled to repair and return it.

    The other question which I will undoubtably be slightly dubious of the answer for, how is she insuring the new car? What has she done re her NCD?

    No, I think the car was stolen about 4 months ago. The 14 days refers to the time between which the car was stolen and the time at which the police advised the friend that it was likely to be unrecovered.

    I'm not much of an expert in this field, but it seems to me that the friend has done everything that was asked of her by Tesco's and they have not been acting properly on her behalf.

    I would imagine that aljie is looking for helpful advice for a friend. Seems to me to be a fair point for a thread.

    Thanks again for everyone's advice, particularly over getting transcripts of the phone calls with the insurer, which I think should be my friend's next course of action.

    I am sorry if there has been some confusion over timescales but RuthnJasper has interpreted correctly what I intended to say. Fourteen days after the theft, the police advised that the car was unrecovered and the insurer could pay out. Four months after the theft, the insurer had still not made a total loss offer.

    vax2002 - sometimes people do not have internet access, may not be aware of the existence of sites such as MSE, or may simply be too worn down by struggling against the system to make these sort of enquiries themselves. That's where friends come in. I am simply trying to help a very upset young woman friend. Unfortunately, yes, it is difficult in these circumstances to get things absolutely right, but I am doing my best!
