Continous Payment Authority(CPA) set up on a credit card do not get cancelled automatically. Though I do not understand the logic behind it, sadly it has been that way. In fact until recently you could only cancel the CPA by contacting the vendor. I think they have recently amended or proposed an amendment in which you can write to your crad provider and request cancellation of the CPA and they have to oblige.

In your case was the insurance provider the same as the card provider? In which case I would expect they would be on a sticky wicket if they feigned ignorance. but if the provider was different to the card provider then you may be on a sticky wicket. But no harm in writing to them and requestinga refund. Get details from your card provider and then follow up with the Insurance provider.

That all sounds very alarming - this kind of thing is why I stopped using a credit card! I'm still a bit shocked by it - not so much that cancelling a card doesn't cancel these things, but that no one seems to know that. I feel that this should have been explained to me when I cancelled my card... not that that would have helped me in this case because I wasn't aware I had any recurring payments on it. If I had known there was recurring card protection on the card I would probably have asked myself if it needed cancelling.

I have no idea if the card protection was with MBNA or a third party. My old statements have PPI on them as well, which I also didn't know about, so I assume it's possible that that is still running on the account as well. I'm writing to them now, asking for full details of all charges made to the account in the last six years, so perhaps I can make a claim for both.

    Thank you!

Is it actually legal for a company to continue to hold your information and an account in your name if you expressly state that you want it closed?

Yes, it's legal because there may be queries from the cardholder re disputed transactions, section 75 claim, PPI claim etc. So they can hold it as it's still required for them to properly manage the account and their business.
