Old Loan - Debt co wrote to me...

Help !

I got a letter this morning from a debt company who are tracing a debt (which I had genuinely forgotten about) from a previous address some 7 years ago. :eek: :eek: :eek:

The original debt was taken out when roughly 12 years ago (maybe more) and I was paying back small amounts until I moved out of the previous address approx 7 years ago.

I kept the same correspondence address for the last 7 years and they say that they could not find me - I am sure it would not have been difficult. I have not been hiding and have had 2 mortgages, a car loan and various c cards since then so not exactly invisible on the financial front.

My credit history has been unblemished for quite a few years now as I am so careful with what little money I have. I have paid off ALL my cards and loans now :D

Anyway, someone on another website mentioned that they cannot pursue the debt if they have not been in touch for 6+ years.

Is this true ?

Also, can they charge me interest for all this time ? They say they will freeze the interest once I begin making payments.

The thing is, I don't want to pay. Or at the very least, I don't want to pay the last 7 years of interest as I feel they have not made reasonable effort to find me in the same town only a mile from the previous address.

What can I do ?

    After 6 years with no contact the loan is null and void :)

    after 6 years the debt is statute barred, cant be enforced to pay, you can if you want though!!

  • Can i just ask? would this show up as a blemish on the persons credit history?
    My Oh is going thru a very similar thing, loan, well, credit card debt, from 10 years ago, no contact for years, altho we havent hidden, will non payment, and sending back mail marked "gone away" affect the credit file, and make other creditors think also that you have "gone away"?

    It is entirely possible that the debt is statute barred now if no contact and payment has been made in the last 7 years. Have you checked to see if they have obtained a CCJ though in which case the statute does not apply and you will be liable to repay.

    Your comment above however really sums up your appalling attitude - you left your previous address without informing them of your new address yet it is their fault for not chasing you - stinks.

    I was not asking for comments on my 'attitude' and since you have no idea of my situation regarding this money then I would ask that you keep your personal insults to yourself.

    There are very good reasons why I do not feel I owe this money anymore. None of which I feel like posting here.

    Clearly not all you owed else you would not be getting chased now.

    I do not appreciate being insulted by someone who assumes things and knows only a few facts of my situation.

    You clearly would prefer to argue and insult, rather than to offer constructive advice or cristicm, as demonstrated by this and some of your previous posts.

    I understand that people like you sadly do exist but I have learned not to be riled by your sort.

    As mentioned above you may find that they have issued a CCJ which if they weren't aware you had moved would have been registered against your previous address - although is this is the case i would be supprised that you haven't had any difficulty in getting further credit. If there is an unsatified CCJ it would be worth repaying.

    Otherwise no over 6 years with no attempt to contact you i beleive = no amount outstanding.
