Online misprice query partially delivered...

I ordered 2 sets of six plates online, at a really good price. The website is one of those that groups suppliers in one place, like a homewares market place.

One set has been delivered.

I rang to query where the other set was. They said they would contact the supplier, but they rang back to say they wouldn't be sending them as there was a pricing error and wasn't I lucky that they were letting me have one set at the misprice.

My query is that according to their website the contract is formed upon me receiving an "order despatched" email. This stated 2 sets on it (as did the delivery note) so are they obliged to send me the other set?

  • Legally I think that they are obliged to. Making them do so is another matter unfortunately.

    Have they offered a refund for the mis-priced second set?
    Thinking critically since 1996....
