Laptop specs not really what they seem?

Hi there,
My boyfriend bought yesterday a shiny new laptop so he could play a newly released game (Diablo 3). He opened it, installed the game last night and... He's not happy with the performance of the laptop. The specs of the laptop should be more than enough for that game in all areas, but still doesn't cut it.
I can only imagine that there is some fault in it? But of course, this is very difficult to prove!!
Would this qualify for a refund?
for curious people, the laptop is an ASUS N55S i7 and game requirements are these

Just out of curiosity did he check against the min spec for the game or for the recommended specs? How has he set the game graphics are they all on full? How does it compare if he turns them down?0

Only having had A REALLY QUICK LOOK (so please feel free to jump in and correct me if I'm wrong), the graphics card of your laptop doesn't meet spec in all areas. If you look at the difference in CUDA cores, Texture fill and a couple of other specs, your laptop's mobile GPU doesn't quite compare to the required spec (although granted it out performs in other areas).
Did the sales person explicitly say that you could play Diablo 3 on this machine?

I imagine he played around with the settings, he usually loves doing his own fine-tuning

I wasn't there yesterday while the purchase was taking place, but the day before when we were browsing through the shops, we asked casually if he thought it'd be OK for the game and the guy said that yes, it should be fine
I see what you mean about those specs
you are right. It's not like he cannot play it (it does definitely have the minimum requirements) but I guess if it doesn't match up all the recommended specs, you cannot expect it to perform perfectly... 0 -

What is the issue with the game.
Too slow/jerky?
Low number of frame per second?0 -
Jerky at points...
Anyway, thanks guys! He figured out the root of the problem may be the graphics card drivers rather than a hardware problem
He downgraded them and it's much better!
So he's not thinking about returning it anymore :j0
