B&Q 12 month guarantee????

Hiya.
I bought a fitted bathroom suite 15 months ago from said company. The combined shower and tap isn't working, this is a prob we have had fixed 6 months ago by B&Q because they fitted the bathroom. They now say that it is out if the guarantee period and need to contact the manufacturer. Is this right??? Also the toilet seat keeps flinging off ( no fun when you are on it and follow ).
I just want to know where I stand, I have looked for similar situations on the board so as not to bother folk with this but feel I need advice on this individual case.

    Have you contacted the manufacturer and told them of the situation? They may probably just replace it if you have had it "fixed"(and i use that term loosly!) before.
    Generally when you deal direct with the manufacturer they seem to be more efficient.

    As you can prove that the fault was there when it was under guarantee they should sort it out for you.

    It's more the other way around!

    The manufacturers are only liable for their guarantee and whatever that covers, once that is up, that's pretty much it.

    However, B&Q will be liable to you under statute law (your statutory rights). If they fitted the bathroom as well as supplying it, then they will be liable under the Supply of Goods and Services Act 1982, which states that all services you have carried out must be done with reasonable care and skill, and all goods supplied as part of that service must be of satisfactory quality, fit for all normal purposes and as described.

    Your rights under this Act can last for up to six years, but will weaken over time and will not cover normal wear and tear.

    For example, they may possibly argue that the toilet seat has broken through misuse - it would be down to you at this stage to prove that it is faulty and not through misuse or wear and tear.

    However the fault with the shower and tap does seem to be ongoing and I have doubts that they could argue that this is normal wear and tear.

    Anyway, I would suggest that you write them a letter giving them detail of what the bathroom is, when it was fitted etc, list the faults, state that therefore the bathroom is not of satisfactory quality and does not comply with the terms of the Supply of Goods and Services Act 1982 - and give them a reasonable date by which to put the faults right at no cost to you. See what response you get.
