No-one will go to court to argue over £55 and they know it. Would you?

    Why not?

If you are sure you are in the right, then go to court (if necessary). I've done so quite a few times now for initial amounts significantly less than £55. It's why the small claims procedure was created :)

It would help to see the exact wording of the T&Cs.

There is an element of "what can they do about it" in rental car T&Cs, so the more people that challenge them the better.

A lot are very poorly written as well. Contract terms aren't automatically enforceable because they're 'in the T&Cs', not by a long chalk.

    OP needs to clarify...

It sounds to me like the OP did go into the Congestion Zone, and paid their zone fee as they should have, but.... they gave the wrong vehicle details.

If this is correct, TfL were correct to issue PCNs, via the Rental Co, who added their admin fee(in resepct of their/leasing co. costs), correctly within the terms of the contract (see below).

OP appealed to TfL as they paid with worng vehicle details; TfL refunded/waived the PCN.

So, the admin fee is still valid as a PCN was dealt with and was due to an error by the OP.

The 50% off seems to be a decent goodwill gesture.

End of comments on the events & the PCN and the validity of charging a fee.

However - with regard to the charging of an admin fee for the PCN, the amount must not be disproportionate to the cost, otherwise it would be an illegal penalty. OP could ask the rental/leasing co to justify their fee based on the amount of work involved in administering it. They might find that they can justify half of it anyway, so would they get owt back? who knows?

You don't get it do you. Those staff had to administer the PCN because of YOUR mistake. Its not the hire companies fault you cocked up so they are passing their costs on to you. These additional costs were not included in your hire because for most people they don't occur

The 'admin' charge should be proportionate as pointed out by real1314. £55 to write a letter seems a bit on the disproportionate side to me.

They are the registered keeper of the vehicle so they have to deal with it. If they ask you to pay and you don't then they would be prosecuted

    Prosecuted for what?
