A number of years ago I part settled a overdraft through Cabot Financial services, the original debt was with Nationwide, they refused to talk to me and said I had to make any offer of settlement through Cabot, who were acting on their behalf. I contacted Cabot Financial and they agreed a settlement figure with me, this was all conducted on the phone, I asked if it was in "full and final settlement", they said it was, they sent me a letter within a week which clearly stated in full and final settlement of the outstanding debt.:j I then received a letter from Nationwide saying that a regular payment I had going to this account had been received. When I contacted them they said that the account was still in debt and they had not received any notification of settlement. :mad: I then spent many days contacting both companies as they did not contact each other. Finally, Nationwide agreed that they had received a letter, but as I did not pay the full amount, they do not write off any debt, they put the outstanding balance on my credit reference file, where it will stay for 7 years or until I settle it.
My question for anyone who may be able to help me.
I received a letter from Cabot, who were acting on behalf of Nationwide, claiming my part payment was in full and final settlement, Nationwide refused to take any calls about the outstanding debt from me and referred me back to Cabot. Can they then contradict the settlement by still putting an outstanding debt on my credit file?
