Help with accessing savings to pay care home fees

    In Scotland, it's possible to make a (relatively cheap and simple) application to the Public Guardian office to access someone's funds for specific defined purposes e.g. to pay care home fees. Very useful where someone no longer has capacity to make a PoA.

    Is there any equivalent to this in England which the OP can use?

    That seems just what I want but I had a quick look around and it seems that , for some reason, Scotland are ahead of the game with a common sense solution to such a problem. Can't see anything similar at our equivalent OPG.

    My Mum went from Hospital , after 4 months, into the Nursing Home last week. She had a sort of informal assessment at which it was decided that she would not qualify for Continuing Funding . We have now completed a form at the Nursing Home for an assessment to be made for the Nursing Care Allowance of £108 per week, which I am told will be a formality. I believe this will be an NHS allowance and assessment, so where do the Council actually feature in this process for me to follow up your suggestion about interim funding. she hasn't actually been ' placed' by anyone, we just arranged it ourselves.

    As for Attendance Allowance, will we have to do this via the DWP appointee process or are we able to claim it on her behalf as she is in a Nursing Home already?(perhaps with some kind of confirmation from the Manager there?)

    You can put in the claim yourselves, but make it clear why you are doing so. DWP will probably contact you about it. If you have a look at Part 11 of the form which you can see (and complete) here, you will see how your circumstances are covered.
