distance selling regs for late holidays???

I need some advice please.

Last night my hubby booked a late deal over the phone. I sat with him- he asked for 14 nights bla bla bla.

We booked and paid but after he hung up he didnt know which airport or flight company we were with. I rng this morning and the lady advised we are going for 7 nights only???

nothing was re capped etc on the phone or any terms and conditions. We had no idea this 14 night request had changed to 7 if she did say something it could only have been once as he didnt pick up on it. All they can do now is charge us an extra £649 for the extra week.

Our credit card company has to wait for payment to go through before doing a dispute. Does any one know our legal rights to cancel with any cooling off periods/ distance selling regs please?

    Once the deposit or the holidays have been booked very unlikely you'll get a refund and very doubtful that your credit card provider will help either. Depending on travel agent they might agree for you to book a different holiday...but really you should check their terms and conditions which is fully binding when you made the booking

    I think it will probably hinge on whether or not theyve got recordings of the conversation with your husband, and if they can show that they did say it was a 7 night holiday.

    If they didn't say it, or can't prove it, just keep on at them saying you asked for a 14 night holiday.

    Much shouting, in this type of instance, usually results in them refunding you purely to get rid of you.

    A bit busy right now, but to briefly answer the OP's direct point - DSRs only apply in a limited way to package holidays, no right of cancel. Might be worth checking the package holiday regs - perhaps someone else will know.

    Aside from that: if a 14 day holiday was booked, then a 14 day holiday must be provided or the deal is off. Evidencing what was agreed is another matter, of course.

    In some situations, I agree, but it really depends on who the OP is dealing with. The difficulty with making a booking over the phone is that, aside from the lack of evidence, the agent can very easily hang up on the caller .... In fact if they have caller ID they can choose to put the caller into an endless loop ... So no real solution.

    OP, who have you booked with? Was it a package, or a hotel plus flight booking? Was it a low cost flight operator (Ryanair, Easyjet etc)?
