Clamped on Private ground. (Flats car park)

MY son parked on private ground at his girlfriends flat. He was in a parking space marked for the flats. He was displaying a parking permit for the use of the space. He was correctly parked. His girlfriend pays for two parking spaces with the rent for the flat.
His car was clamped during the evening. The clapmers reply line operator was totally rude. The refused to remove the clamp that evening so he could not return home. Following morning they charged him over 200 pounds to remove the clamp. The clampers agreed he was legally parked and should not have been clamped. Police also attended. Agreed he was legally parked. could not help as on private ground. Waiting for clampers to attend made him late for work.
Can we cancel card payment to clampers?
What recorse do we have
Can we claim for loss of use of car, inconveniance, late at work, stress etc?

    You can claim for anything you like. The problem you are going to have is to get them to pay up.
    I can afford anything that I want.
    Just so long as I don't want much.

    What a pain. It is disappointing that the police did not assist, I would complain to the Chief Constable. IMHO they should have cautioned the clamper for his actions as a breach of the peace.
    You cannot cancel if he paid by debit card. He may be able to dispute the charge, if he paid by credit card? If he had paid by cheque, he could cancel.

    Whoever hired the clampers can be made to pay, though. Who was that?

    I also think you need to take the matter up at a more senior level with the police. A couple of PCs would just want to wash their hands of it, but you need to go to Inspector level or above, where hopefully someone will have the brains to see this for what it is- criminal act.

    apparently Visa debit cards also offer a chargeback scheme, if you claim that you have paid under duress, theres a thread on pepipoo here http://forums.pepipoo.com/index.php?showtopic=69864 with a bit more info.

    you probably wont get anything form the clampers, as they collect CCJs as if its a hobby, going for the people who hired them will usualy bring results.

    You will need to find the landlord of these flats.
    Forget the clampers, you will get nothing.
    But track down the landlord and we will help you to sue them for the money back plus some compensation for the incident causing him harm at work.

    First thing to check is the paper work and does it have a SIA number.
    If it does, then find the landlord details and come back.

    EDIT :
    Another point is if you have given card details over a phone to crooks and con artists, you need to cancel the card as well as the bank will not refund any more charges they make as you gave them open ended permission to use the card as they wish.

    Due to the Freedoms Bill, clamping will be made unlawful in England from October.

    As has been predicted on here, we expect to see quite a few cases of clamping where no one has done anything wrong at all, as clampers fill their boots until October.

    You need to find out who hired them. Is there a management agent who looks after the flats? Did they hire the clampers? If so, you need to sue them, we will help with advice on how to do this.

    Also, let us know how you paid, there may be a possible route to a refund there. And as others have said, a complaint against the police.
