Following one success with M&S and one rejection from NEXT who say they were not regulated by the FSO I am going to take them to the FSO as surely they have become regulated by them at some point while I paid unnecessary, unexplained PPP to them! Will keep you informed & wonder if anyone else has had success....

You are mixing your initials up.
The regulator on post 2005 cases was the the FSA. If a firm became regulated by the FSA in 2005 then you have a right to go to the FOS. If it is before 2005 then you may still be able to with some firms but not others. Next are saying they were not regulated by the FSA and therefore you cannot access the FOS.
Mis-sale relates to the date of the sale. Not the premiums paid.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
Since 14 January 2005 Next Retail has been an Appointed Representative of FirstAssist.
It has never been regulated by the FSA. Therefore, complaints about PPI sold on or after 14 January 2005 must be answered by FirstAssist and can, if necessary, be taken to FOS.
Those relating to policies taken out prior to that must be answered by Next Retail but cannot go to FOS.
The OP has the right to check this with FOS but that will not change the issue of jurisdiction.0 -
