ESA, How long does it take to get statement of reasons?

I got a phone call on Tuesday telling me I failed the medical and only received 6 points. I told the woman on the phone I would be appealing. But I still haven't received any letters about the derision, how long should this take?

I was under the impression I only have 2 weeks to appeal, how can I get my appeal together when I don't know what they have failed me for.

    Sadly ESA admin is a disgrace... I've been on ESA 3 years and never received a decision in writing.. or at least never received a correct decision in writing! Ask for a written statement of reasons and ask for a copy of the evidence they've used... that should include an ESA85 (medical report) is you had a face to face ATOS medical or ESA85A if not. You get a month to appeal... if you run short of time then just do so and tell them you'll provide more info/evidence soon when you've had opportunity to study evidence and/or consult GP etc.

    Appeal must be made in writing.. can use a GL24 to do it. There should be plenty good advice on recent ESA threads as many are appealing etc. Focus onthe descriptors you feel apply to you in your appeal.

    It'll be about a week, post dependent. They're normally collated and sent off 24-48 hours after the phonecall. Remember there was a strike on Thursday, that would have delayed things too.

    The timelimit for the appeal is normally 4 weeks.
    _however_.
    If during this time, you request a statement of reasons, and it's not delivered by 4 weeks, the limit is 2 weeks from the day after the SOR was posted.

    So, if you request it at the third week, and it's not posted till the fifth week - you have up till the 7th week to appeal.

    It's a good idea therefore to keep ringing up at least every week, to make sure you diddn't miss it in the post.

    If you need the money - then you need to appeal in writing - you can follow up with more detailed reasons later.
    You may not get (should not really) unless you have submitted an appeal in writing.

    Don't forget that you will need to submit 'Fit notes' from your GP in order to get paid whilst awaiting your appeal (which could take in the region of 12 months).
  • Did you ASK for a statement of reasons? You don't necessarily get one, unless you ask.

    I've never received the either had last medical a month ago and still waiting..
    I always take the moral high ground, it's lovely up here...
