Care needs increasing

o/h has Dla hr and Care allowance at lrate , her care needs are slowly but surely increasing , should i inform the DWP ?

    Yes if she is requiring more care. Just remember that a review can mean you loose the current award for mobility and care, but this is rare from what I have read.

    It also means they can increase the award but it's not guaranteed. It could go either way.

    I went and won a tribunal last November. My care needs have increased. SS have someone helping and I now get taken out on wheelchair at times- although I know this is mobility.

    Should I leave it or reapply? Have many people been 'lowered' when asking for more needs?

    This is the exact-same scenario I faced quite a few months ago with my wife.

    I would strongly advise you to ask for a "supercession" of the award on the grounds that care needs have increased.

    Be prepared to get supporting evidence - GP Letters, Consultant letters, etc., and be prepared for it to be knocked back first time - simply appeal, in writing and then you'll probably find the DWP will refer to a Tribunal.

    Overall, it took us 13 months to achieve the appropriate result, but all payments were backdated to the original date of application for supercession.

    We were 'warned' that the Tribunal would look at both elements of the award and there was a "risk" that we could lose it all. However, this is a standard 'covering backs' phrase and it is unlikely that a genuine case, where needs were obvious would be declined upon presentation to a Tribunal.
