return table and chairs to argos (home delivery)

Hi all,
on tuesday i had a table and 6 chairs delivered to my house. All part of a matching set and one of their offers.
Upon assembling them, the "oak" stain of the table is clearly a differnt colour to the "oak" stain of the chairs - it is like comparing yellow with brown.
I am planning on ringing them tomorrow to send the item back.
Just in case they get funny with me (as i have opened the item) what are my actual rights?
As far as i am aware, i am able to return items with 28 days if i am not happy with them, providing they are in the original condition (which they are) - i still have the boxes too (if that makes any difference?
I am also under the impression that if you do this within the first 7 days you have even more rights for return?
Any advice prior to my call tomorrow would be very welcome

I believe the 7 days you are referring to is distance selling regulations. If purchased at a distance (ie online or over the phone) you can notify them of your intention to cancel within 7 working days - starting the day after receiving the goods.
The 28 days you refer to is merely their company policy and not something afforded by law. If you bought the goods in store you don't have a statutory right to return unwanted goods.
Although this would be a case of the items 'not as described', giving you the right to reject the goods under the Sales of Goods Act (assuming of course this is the case here). For which they should cover the costs of restoring the goods to them.0 -
Good advice from arcon5 but I am wondering about your "assembled" comment. I know I have seen this mentioned under exclusions in some T&Cs.0

Argos had no problem with a dining set bought and assembled - it was far too big once up. I mentioned that it had been unpacked and although we had kept most of the packing, some was too damaged but they simply asked that it were packed up as well and securely as I could. They collected it a few days later, but I did have to chase 4 weeks after for the refund which then appeared quickly.0

As arcon5 has pointed out, you have 3 sets of rights
DSR and SOGA which are law
28 day return policy - which is aprt of the contract as Argos give you those rights.
I would go for SOGA as not described and then Argos would be liable for the return costs.
However if the problem was obvious on unpacking and did not require full assembly then you may be on sticky ground under SOGA. You can only reject goods if you have not 'accepted' them or done something which is consistent with accepting them. If you have assembled them when the issue was obvious then you may well have accepted them - its a debatable point though..
You could still return under DSR but you would not be able to claim return postage unless it was aprt of the cotnract. Unsure what Argos own policy says about assemlbed items though.0
