    You need to go back to your insurers as the story doesnt make sense.

    If they are disputing liability then they need to give their clients version of events and you can then assess them against the damage and make a decision on what to do but as others have said with no witnesses 50/50 is a frequent outcome.

    However you say it is the damage that is disputed (ie quantum) in which case they should be admitting liability but only offering 50% contribution to the repairs (which is different to a 50/50 settlement)

    In previous correspondence the Third Party claimed I had left enough room, but as they sped up to undertake me, they're saying that I closed the gap intentionally.

    Guess you're one of the one that stares straight ahead, and refuses to let anyone from the coned off lane in? It may not have happened here, but it's common to split 50/50 as both drivers reasonably expect to finish in the same place, if both insist on keeping going.

    Nope, i genuinely didn't know he was there..first time i i saw him was when he was in my wing mirror and i realised what he was trying to do. I started braking there and eventually stopped. He kept going but unfortunately there was no longer any room for him to get through and his trailer hit my car.

    Also it was fairly tight as we had just left a set of red lights, so there was a fair amount of traffic on all sides. Not like i was purposely trying to run him into cones!
  • Have you had an independent engineer or some such look at your car?

    When a friend had a accident they sent out a guy who was able to look at the damage and reconstruct what happened. Might be able to help you if the third party's account is different to your own.
