personal injury claim after a car accident (no fault)

hi there

could you please give me advice on the follwing: this monday i was involved in a serious car accident when someone pulled out in front of my car. I suffer from bruises, headache, neck and back pain and have panic attacks thinking of driving. I called the insurer of the driver who caused the accident and they organised me a replaycement car until i do not get a cheque for my old one as well as informed me that i am not entitled to claim for anything else. Earlier today I got a telephone call from an independent insurance company who informed me about possibility to help me with a claim for my personal injury. I am not sure where they had my details from, who could pass my details to this comapany, how they get their money paid as they say i would get 100% what i am entitled too.

Does anyone here can help me out and advice what should I do?

Can I not claim glasses replacement myself?
Is there a guidance what actually I am entitled to claim back?

Many thanks

D

If you have a legal cover on your own insurance, give them a call. Otherwise use a no win no fee comapany. You can claim for any losses, and injury. If the other parties insurer are telling you you can't claim glasses etc if they were broken in the accident, you definately need a no win no fee company to represent you, as they will try to pay you less than you are entitled to.

Under these circumstances I would let your own insurance company deal with it, they will point you in the direction of a claims management company for your injuries.

If it was just vehicle damage I would normally advocate dealing directly with the third party ins. but it looks as if it may get messy.

The other partys insurance company will have passed your details on to the people who rang you. you will likely get scores more before you see the end of this. Just tell all of them that the issue is being dealt with already, thank you very much and put the phone down.

You pay your insurance company to deal with things for you so let them do it, it will be a lot less stressfull seeing as you are having physical problems.

Ive been through this twice (with out the physical damage) so I know how stressfull things can be when you yourself have done nothing wrong. Just forward everything to your insurance company and claim for ALL losses.
make the most of it, we are only here for the weekend.

thank you for your advice - the only problem is i am insured abroad and they say they have different rules than UK so this why i am not sure who i can trust. it is a shame that the driver just ignored me in the place of the accident and even did not say a word like sorry or so... still thinking what i could have done better but it is like a circle which never ends :(

I hope you have had the car in the UK for less than 6 months, otherwise you are driving illegally (although you won't be the only one by a long way):

    http://www.direct.gov.uk/en/Motoring/OwningAVehicle/Motorinsurance/DG_067628

Any vehicle used in this country for more than six months in any 12 has to be registered and licensed here in the normal way with the Driver and Vehicle Licensing Agency (DVLA). In addition, where the keeper of the vehicle becomes resident in this country, the vehicle must immediately be registered and licensed here. Once a vehicle has been registered in this country its use must be covered by a motor insurance policy issued by a motor insurer authorised in the UK.

You should go to an independent law firm that specialises in Personal Injury claims.

The 'claims management companies' that call you pay the insurance company a handout for each claim they pass on. You can not be assured they will act in your best interest or that you'll get everything you are entitled to.

I'm not sure what are you are in but these are very good in the North East: http://www.tbilaw.co.uk/personalinjury/Road_Traffic_Accident.asp
