SDA/ESA changeover

We belived mum was on IB but she has had a ESA50 3/11 in the post and the covering letter said she was getting SDA because she hadnt paid the required contributions for IB. I have filled the form in and returned it, can anyone give me any advice on what come next, mum is bad with her nerves and gets DLA for this.

I though mum would be left alone since she is 60 next month, I rang CAB today about the IB question and apparently in the 80's everyone who hadnt paid the required contributions was put on SDA and not IS, I thought it would have been IS but a few further 'phone calls confirmed she was put on the right benefit for that time because Maggie wanted to fiddle the figures by conning everyone that people on SDA were disabled when they were really just being moved from stats to stats.

    don't get the last part - are you saying your mother is not disabled? if thats the case then she will need to claim JSA and be actively seeking work.

    I presume that your mother is 60 after the 6th April 2014.

    Some people who are entitled to SDA can also get IS. You need to check to see if she is. It wont stop her being moved to ESA ( Presuming entitlement) however if your switched from one benefit to another the government usually adds adjustments to ensure that people are not worse off. As far as the law is concerned its your (or your mothers) duty to check benefit entitlements - not theirs to inform you so check now because the rules for backdating are tight.

    That is a load of rubbish. In order to qualify for SDA you needed to be 80% disabled, or be passported on to it by receiving a qualifying benefit. It was a very generous allowance paid to people who had not paid enough NI contributions. It had nothing to do with Maggie fiddling the figures.

    You have to be considered 80 percent disabled or more and:

    be incapable of work because of illness or disability for at least 28 weeks in a row
    and aged between 16 and 64 years old (special conditions apply for people aged 65 and over)

    There were no passports to it.

    I am on this benefit, but not been moved to ESA yet. I was assessed as over 80 percent disabled in the late 90's and they exempted me from the PCA test too.

    However I have had to send sick notes in every year. I haven't had any notifications to keep sending them for the last 5 years but I do still send 12 month ones in.

    I do get a strange amount though. The age addition I receive does not seem to be in agreement with what it's meant to be, nor for the higher rate age (not entitled to that one anyway) :o
