VISA chargeback AND a refund...

Hi

I bought a jacket online on what turned out to be a very dodgy site. The jacket didn't arrive, the tracking number was wrong, and then two refunds didn't go through. I gave up with the company after loads of contact with them and broken promises to refund my money, so started a VISA chargeback with Nationwide.

I checked my account today and there were two transactions - one from the company for £101 and one from Nationwide for £104 (the correct amount). I went into Nationwide to tell them that the company had refunded me, and the girl I spoke to was very shocked I was telling them of this error and that I wanted to give them the money back - and she told me "Don't worry about it, don't say anything, keep it" - Surely this isn't right?! I am worried that if I follow her advice, even though she works for Nationwide, and I have noted her name and the date I spoke to her, I would be penalised if I kept it?

I am sure I should go back to Nationwide again! Is there a time limit on this? Just extremely confused as I did what I thought was the right thing and was told to keep my mouth shut!

I'd be very surprised if Nationwide don't reverse the chargeback as I'd expect the company concerned will most likely contest the chargeback, stating they refunded you and providing proof.

So I'd let it be known that you contacted your nearest branch and a staff member told you to defraud them (more or less).

If you didn't buy it in the UK, then I could understand the refund being different due to exchange rates.

The chargeback should reject and your account will be redebited again. If it doesn't, you will keep both credits.

Chargebacks are virtually never anything but to the consumers advantage, if you look at the uk small business forum companies are even recommended not to even bother contesting chargebacks but instead go directly after the buyer directly with a letter of intent to issue proceedings.

If nationwide say they wont do anything then keep the money aside and sit there and wait for the merchant to approach you (they have 6 years to do so). If they do then pay up if they dont then they dont.
