I have heard of the imit + 10% + 9mph = 42mph and the officer did say that I was on the cusp, so it could go either way. I admit to expecting the 3 points and fine.

There seems still to be an issue about the NIP, were you warned at the time that you might be prosecuted? If so that requirement is satisfied and as has been said there could very easily be further action despite the delay.0

What GTFA is driving at is did the officers say: "You will be reported for consideration of the question of prosecuting you for speeding/excess speed"?
As antiquated as it seems this specific form of words are required if there was a chance that you would be prosecuted. There is no requirement for it to be used if, ultimately, you were to receive a FPN or a course which is exactly what it seems you were told. Similarly you would also have been cautioned: "You do not have to say anything but it may harm you defence if you do not mention when questioned something you later rely on in court....". Does that ring any bells?My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
