Court papers for road repair costs after insurance claiming settled

Over a year ago my husband had a car accident whereby he lost concentration and hit the motorway central reservation. His car was a write off, the barrier was damaged but no other vehicles were involved. The police attended and did not press charges.

Zurich agreed to cover the claim in full. We had a call from the road maintenance company a few weeks after the accident asking whether we or insurers would be paying for repairs to the barriers and my husband provided Zurichs details

We heard nothing further, until today when we received a court form CPR part 7 saying that my husband is liable for the £1000+ cost of repairs plus legal costs. It's the first communication received on the matter since the phone call.

We've tried calling Zurich but the claims dept is shut until the morning. My husband is really upset about this. Has anyone experienced similar? I would be so grateful for any advice. Thank you

    Just pass on the correspondence unanswered to Zurich. It is their problem and they will sort it.

    Tell him not to worry. (They are allowed to go home at night!)

    I'm just worried that if Zurich havent got organised to pay the repair in over a year, they are not going to deal with this within the next 14 days as required by the court documents :(

    Thats why you should leave it to them, and don't try and reply/defend yourself. Then should anything go wrong. they are responsible for putting it right!

    And what if they don't? The end result will be that Zurich will have to pay for the damages if they take your husband to court, your husband (having a valid insurance policy) won't have to pay a penny towards the third party damages.

    Tell him to stop worrying, and just inform his insurers asap to let them deal with it, it is not going to cost him £1,000 or anything like it.

    Whilst everyone blames the insurers it is can also be the claimants that havent gotten their act together. Certainly in my day we would frequently receive correspondence from our insured years after an accident to say they've had a letter from the council/ highways agency etc claiming for damage to street furniture etc.

    As others say, even the evil people insurance get to go home occasionally. Pass it to them and they will deal with it for you.
