Hi, can I get a quick answer please??

Hi,

My husband has received a parking fine. He was parked on the pavement, but there were yellow lines around said pavement. The contravention is:

01J - Parked in a restricted street during prescribed hours

We have pictures of the van. My question is can this fine be enforced as the whole van was on the pavement?

I have to pay this by tomorrow hence the need for speed.....

    Not enough details, but the yellow lines on a road go between boundaries of the buildings, not the pavement. If you park on a pavement by some double yellows you are still in contrvention of the double yellows.

    Yes the pavement is normally considered as part of the highway and yellow lines work both ways.
    It is an offence for vehicles to be parked wholly or partly on the pavement if the highway at that point is marked with yellow lines that are in force at the time. The only exception is if the vehicle is actually parked on private property the far side of the pavement.

    You are allowed 20 mins to load or unload (assuming there are no signs or pavement blips to indicate otherwise).

    You can still try appealing the penalty for some other reason. That will give you a bit longer to consider paying it at a reduced rate.

    As has been said you need to post many more details. He could have been loading and no penalty due.

    OP, get on to pepipoo and someone will take a look at the ticket and signs and lines for you. No one on here has even seen the ticket, so we have no idea whether or not it's correct.

    Don't pay anything just yet!

    So great is the proportion of council tickets (and procedures) that fail to comply with the law that is always worthwhile appealing council tickets. Did you know that 70% of council issued tickets that end up before an adjudicator are quashed?

    As sarah has suggested slip over to pepipoo (their council ticket section of the forum) and post your case there. There are plenty of learned minds there who will minutely dissect the ticket's wording. You will need to scan in both sides of the ticket - and obscure any details that will identify it as the one issued to your OH - before posting it into a thread.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
