Dog injured by fence put up by council - attempting to claim

    I think most of them would to be honest.
    Perhaps if it was someone else's child.
    But if it's their own child I'm sure most people would be incensed and off to a "no win no fee" solicitor to get compensation.
    You only have to look at car insurance to see that widespread behaviour.

    OMG! My listing was completely tongue in cheek! My cats pile up all sorts of rodents in the kitchen several times a week which I clear up with no stress! I was just trying to make a point.

    What I would say is that whilst I am not being unsympathetic to the original listing and the injury to their dog, I am fed up with this litigious culture we live in today.

    Yes, the council may have a duty of care, but in this case, who is to say that the alleged damage (to the fence) was caused as a result of negligent action by the council or operatives acting on their behalf. There are so many things to think about in this particular case which have been pointed out already. We could go on and on.....and on.

    I'll conclude by saying that I am the kind of person who just deals with life as it comes and takes responsibility for my own actions.

    I don't see how your point is analogous at all.
    Unnecessary injury to an animal is in no way analogous to their normal activity which any owner should accept.
    Please try to explain your point as I'm not seeing it at all.

    Me too. I am totally against fraudulent and frivolous cases.
    However I don't consider physical injury to be frivolous.

    I agree we don't know full details but generally I assume people are telling the truth.

    Great attitude, but how can someome be responsible for their dog (or even young child) getting cut on a fence?
    If it were your child that were bleeding and scarred for life are you honestly saying that you would say "Oh well, never mind".
    If it were a 9 year old playing football would you say that's your responsibility and you should be holding their hand 24/7?

    Happy to carry on, but sometimes it's best not to moralise and stick with the helpful advice that the OP came here for :-)

    eek...didn't want to start an argument about the immoral and litigative society we seem to live in....but at least it kept my post bumped..
    as for my situation..
    i've walked my dog on the same ground for 18months off the lead..(and the fence was there for all of that time)..however the time she got hurt she ran too close to the fence and had the sharp pointy ends of the wire been either trimmed neatly or nailed to the post, it wouldn't have been an issue...however they weren't and as a result i was faced with a £600 vet bill.
    I've claimed off my insurance for it..but would only like my excess and my petrol + time for trips to the vets re-imbursed...a number of witnesses (and my wife) have demanded i sue the council, but i'm not interested in that, i just want recompense for something that shouldn't have happened..wasn't my fault and was (i feel) due to poor sub-contractors.

    and the council could argue your dog was injured at a time, when your dog shouldve been on the leash.
