Link financial mbna credit card debt help

    I had an MBNA card debt that was bought by Link. In better times i was paying 300 a month. I got the debt down to the last 400 quid or so when my finances hit the skids again and i stopped paying.
    That was about 5 years ago. They still ring me periodically, sometimes i ignore the call, and sometimes i take the call and tell them i'm skint... but the chickens are laying well at the moment so i can pay them in eggs.
    The nice man at Link seemed to think i wasn't taking things seriously.....
  • Hi Guys... Thanks for the advice above, ive also had a CC debt sold to Link from MBNA. 1st contacted them in April, outlining what I could afford to pay each month, eventually heard back yesterday, in a nut shell, they wasnt prepared to accept a payment plan, but were willing to a 1 off payment for half the amount (amount owed 19,000) IF i could raise the money by the end of August, told him there was no way I could raise that amount by the end of August, he basically told me to beg, borrow or steel to make the payment.
    Obviously I was a little thrown by their reluctance to accept monthly payments.
    The CC was originaly owned by Santander, who I had an account with, so interest was low, and could afford the repayments, but it was transferred to MBNA, the payments doubled, but I can not recall recieving or signing a new agreement. I have printed off a letter from the link above. The £1 fee, should that be made out to Link? Also I would like to send another letter to them stating that I can not afford the payment in full, and offer a sum each month. Is there a link for this kind of letter anywhere?

    Any other advice dealing with Link who be most gratefully recieved.

    Leave the £1 PO blank.

    DO NOT, under any circumstances, write to Link offering them payment. Wait to see what they come back with first.
  • Hi link never responded to my offers of payment they went straight for a ccj :( I heard that they are notorious for being harsh !

    They told me to take out loans ask friends ect for the money!

    I hope you get on ok with them do you own your home ?

    I have Link on my back at the moment - phoning everyday at work and when my colleagues say I'm unavailable they start putting pressure on them by saying things like "are you telling the truth? Are you covering for him". Really narking me off.

    If they do go for a CCJ, what can they do if its granted?

    Worst case scenario they can get bailiff's to enforce the CCJ.

    It's against OFT guidelines to call you at work.

    Go to the CAB or CCCS and compile an income/expenditure form. That might persuade them to accept the offer.

    I have never seen anything in any guidelines saying its illegal to call someone at work. The link doesnt say that, it actually says; "which are aimed at causing 'alarm, distress or humiliation, because of their frequency or publicity or manner'". I dont think a discreet call every few days or so is going to be classed as illegal!

    Nowhere did I say it was illegal...?!! However, from the link I posted:

    "The Administration of Justice Act 1970 S.40 makes it a Criminal Offence for a creditor or a creditor's agent (often a debt collection agency) to make demands (for money), which are aimed at causing 'alarm, distress or humiliation, because of their frequency or publicity or manner'."

    Calling someone on a work phone that can be answered by multiple people can be humiliating.

    They are calling every day, speaking to one of 5 colleagues on my section, questioning them as to my whereabouts and why I won't take their call. I did take a call originally and told them not to call me at work, as the calls are recorded. They have emailed me twice at work also. IMHO, they are attempting to cause humiliation by being reasonably public without explicitly saying "We're debt collectors". Bunch of rogues.
