when do companies apply for CCJs

i was just wondering at what point most collection agencies decide to take this action.

i have several large outstanding debts -over 10k - which defaulted 18 months or so ago.

despite my best intentions i have been unable to pay anything off of the balances and the debts have now been passed on from the original creditors to their inhouse agency to external agencies.

i have tried to offer for f&f but no one has taken me up on 25%. i was in cccp monthly payment plan but gave up as was struggling month to month and some of the lenders were still adding interest so nothing was falling

i am terrified they will apply for ccj as this could cause me problems work wise but i am actually surprised no one has done this yet.

the largest defaulted loan is 20k so its surely worth their while pushing this.

any thoughts?

how best to play this?

    How were you able to offer 25% F&F if you can't make any payments?

    I think the risk of a creditor applying for a CCJ is high given the level of debt and the fact that you're not making any payments.

    Can you make any contribution at all?

    I would be looking at whether these enforceable debts or not, check the lawfulness of the debt and take it from there.

    It's very hard to predict who will go for court action. As a debt adviser with CAB, I see a lot of debts. Actually very few get ccjs - probably less than one in ten.

    I see large defaulted loans where the client is a property owner and the creditor seems to accept a small monthly payment, year after year. Then I might see a tenant on Income Support with a catalogue debt for a couple of hundred and the creditor starts a court claim!

    I think you need to choose a strategy that works for you. Was the monthly payment on your dmp just set too high? Why would a ccj cause problems at work anyway?

    If you have such high debts defaulted, your company you work for may have an issue even without a ccj. With that big sums it wont be long.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    i could make f&f offers as i am able to borrow money from my parents.

    i could make a monthly dmp payment to each but i stopped as it was not actually helping me get out of debt. some creditors stopped taking interest but a few did not so net effect was greater debt after 1 yr.

    the difference between defaulted accts and ccj/bankruptcy is very important if you work in financial services.

    a question to those in the know:

    will a dmp stop court action - or is this down to individual creditors etc?
