    No he has not committed fraud. He is on the cusp of committing fraud. The distinction is important to make, because he can walk away from making a mistake at any time up to swapping the keys for the cash.

    Absolutely. The best decision you can make is to call the dealer and tell them what you've done and that the deal won't be completed - then call a reputable debt charity and get some GOOD advice. Even if you managed to do this (which is unlikely) and had the money to pay for this month's mortgage... what about future months? Also, are you in employment or looking for a job? Having a conviction for fraud will make it very difficult for you to get a job and could lead to you being dismissed if you're already in work. I understand how debts get you down and can lead to some crazy thinking, but this is really not a good choice you're making and will lead to nothing but more problems for you, and whatever poor sod ends up with the car.

    i know its fraud but it was last resort,the car dealer never checked
    and offered to buy

    meant to be dropping it off tomorrow and collect money,

    Between now and then the dealer will run the check. Don't expect any cash. Do expect one seriously p1ssed-off dealer!

    gee whizz! you know, i keep seeing on these forums "this is a place for non-judgmental advice" etc etc; but so many of the answers to this question are down-right nasty!! yes the debt free wannabe board is by far the friendliest and non-judgmental board on MSE, but sometimes you get the odd know-it all clique just waiting to pounce on someone just looking for a bit advice! i experienced this when i posted a question on the match betting forum and got absolutley torn to shreds by people saying i was asking questions that had already been asked or that my question was irrelevant etc and when i asked a question about when free offers run out what do i do - to which the answer was "wait till that happens then worry about it!"

    yes selling a car on hp is techincally fraud but no one on this thread knows this guy's situation. he (or she!) may be desparate, they may be fully intending to still pay the finance, it may only have a few payments left to go, they may be waiting on a huge payout from an old auntie's will next month, they may be selling their house and waiting on the paperwork coming through - the guy did not say he was going to sell the car then do a runner!

    yes yes, it is a silly idea but until he comes back to tell us what his situation is then we should not be coming away with comments about him being a coward or go to jail and how selfish he is.

    sorry, i know i'm ranting but it proper annoys me when (and sorry to offend any long-haulers) people make newbies feel stupid or that they are somehow not part of their 'gang' just for asking a question.

    and now i'll probably get told off from someone for even replying to this thread and pushing it to the top of the thread list and bunging up the board and an admin will come along and close it etc.

    i just wish people would realise that there are no stupid questions (most) people ask them for a genuine reason and not everyone knows the etiquette of the boards if they're newbies and they don't know that the same question might have been asked 3 months ago by someone else therefore risking annoying a long timer that has seen it 1 thousand times before.

    OP: don't sell your car if there is hp on it: come back to the board and start another thread and let all the helpfull people know your situation and hopefully there will be lots and lots of great advice on how to deal with your finances.

    I thought the responses had been pretty restrained consider what the OP is proposing to do. How would you like to buy a car with your hard earned cash only to lose it, and the cash, when the finance company repossesses it?
