train ticket fine

Hi,

I regularly travel from Euston to Chester using the value advance saver tickets where you have to travel on the specified train. Whilst travelling to Euston I had a delay of over 30 minutes on the DLR which meant I missed my train. I spoke to the man at Euston Train Station and showed him my ticket, he told me to get on the next train. When my ticket got checked on the next train I got charged £55 for being on the wrong train, the ticket inspector told me that the man at Euston should have stapmed my ticket. I wrote to Virgin who passed my letter and claim on to SERCO the underground company saying that as the delay was due to the underground then my claim was down to them. I had a reply from SERCO saying that they are not liable for consequential loss resulting from the delay.

Is there any way I can get my £55 back? And who from?

Thanks

Emma

You might want to contact London TravelWatch who may be able to help. They will investigate on your behalf if you are not satisfied with the response from the rail company concerned. Though I don't really know if you can get some if any of your money back. The ticket inspector was right. You should have gone to the ticket office, explained the reason why you missed your train and had your ticket stamped to authorise you to travel on the next train. If you don't do this then it is assumed you are travelling without a valid ticket. Good luck!

I know it's a bit late now, but if you get caught like that - DON'T part with any money on the train, give them your name and address. You can then fight it on a slightly more level playing field.
