Deal signed but now Trade in has developed a fault

My car is being traded for a new car however it's now developed a fault (coil plug has failed),The car runs a bit rough only firing on two cylinders but is drivable and is not dangerous, the repair is about £80.

Where do I stand legally? A deposit has been handed over and A deal agreed. My new car will not arrive for over a week.

I would also like to add that if this was sold privately or to a small dealer then I wouldn't hesitate in having it repaired. The dealership who have taken it as a trade in is a big national company and I was offered a poor trade in price.

You shouldn't be driving around on 2 cylinders, part of the excess unburned fuel is going to run down the sides of the pistons, washing away, diluting and ruining your engine oil. The rest is going to find it's way into your CAT, ignite and eventually ruin it.

If your new car arrived with a failed coil plug where do you think you would stand?
The answer to that is also the answer to your original question.

Me too, we should have a SB appreciation society.

Fix the car, of course they'll notice. Common sense.

I would say legally you need to repair your car as you have agreed a part ex price , out of curiosity did they take yours for a test drive ?

you were offered a poor trade in price ? but you still agreed the deal
    whose to blame ther ?

Maybe us dealers should use that line when a customer comes back with a fault..

it was there when you bought it, but you never noticed it..

Seems a good line when it's dropped off as well then.

Find out what the dealer intends to do with the car? If it's old and worthless (you don't say what car it is) then they may just be going to weigh it in for scrap and so won't be bothered.

Had this one with the scrappage scheme a few years back, a friend I was with stopped to help an elderly couple who had broken down with smoke pouring out. Turned out they were on their way to swansea to get a new car under the scrappage scheme but their headgasket had gone. Scrappage scheme required the cars to actually run.

Turned out the damage wasn't too bad, so he towed them to around the corner from the dealership, filled the coolant up with tap water and the couple drove it onto the dealership forecourt as a runner. Car was getting scrapped anyway so they dealership didn't care, everyone went away happy.

Sorry but I don't think you've read my question correctly I wanted to know where do I stand legally not morally ?

Anyway all sorted now, I contacted the dealership and described the fault and they are happy to take as is, apparently the part in question is only a few quid and is simple to fit :T

    Thanks for all the advice
