I have NO signed credit agreement with NEXT

Im sorry I wasn't sure where to post this, hope this is the right place.
I have an account with NEXT directory which ive recently fallen into arrears with.
I owe £1,300 in total.
I called them last week to ask if my monthly payments could be reduced. They agreed to reduce the payments to £80 per month which I can just about manage.
Now here's where it get's interesting!....
while on the phone the woman told me I have NO signed credit agreement with them so she will put one in the post which I was just going to sign and send back until my OH just told me that my whole account may not even be legal without the signed credit agreement and so I may not be eligable to pay any interest (which I have been paying for 4yrs) or late payment fees etc.
Could anyone shed some light on this please.

I opened a Next Directory account online to use a discount voucher they gave me when shopping in-store (the AC is closed now). I too wasn't sent a Credit Agreement but think I signed one online. Is that not the case with you?0

did you fist take out the account?0

Well im assuming No otherwise they wouldn't of sent me one to sign but I honestly can't remember as it was years ago0

I dont think nowadays you need a 'signed' agreement.
You will have accepted the terms and conditions when you opened the account on line.
There will have been a box to tick to say 'I accept the terms and conditions'. If you didnt tick
this box the account would not have been opened.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
I think you could still be liable because you must have clicked a box confirming that you accept the T&Cs when opening the account online.
They must have sent you one but you could have overlooked it with the masses of paperwork they send you when sending a catalogue, pamphlets, leaflets etc.DEBTFREE AND PROUD!!0 -
When you say years ago, was it before April 2007???More than Two Years in
Doing it the Niddy way:j:j:j0 -

only applies to online accounts opened after 1st Jan 20050 -
Mckneff I never once mentioned not paying for the goods I bought but did mention the interest and late payment fees which are outrageously high anyway!
It's only like claiming back bank charges back, worth a try.0 -
OP says she has been paying the account for 4 years which takes it back to 2008.make the most of it, we are only here for the weekend.

if i recall correctly next just used to accept the order and send out a blank agreement. nothing ticked online that would count. nothing signed by you before they open the account. they seem to know they are up sheet creek on this one otherwsie they wouldnt have sent you a cca to sign0
