Seller refusing to honour sale.

From the way I read, OP didn't think this non sale was legally binding, which I would agree with. But seller used Ebay as a platform to sell from & produced an Ebay Auction with a low starting price & no reserve & as Ebay was the platform used to agree on a sale, it is entitled to expect both buyer & seller to honour sales. Surely this is the point when buying & selling on Ebay, Ebay can't legally go outside of the law, but it can expect its members to abide by certain rules.
It is expected, however if the seller feels he has not got the price he should, he could decide to withdraw for his own reasons!
If he did a mistake, genuine or not, it is impossible to prove either!
The thing is, that once a seller says NO, there is no way in a million years that you will be able to change his mind!0 -
Thanks to all of you who posted sensible and constructive replies.
On principle I have left a negative and will raise a NPS with Ebay.
Maybe that will deter this seller from timewasting.
It isn't a "millisecond" as someone above posted that was wasted as it takes time to search for an item, bid on it, make a payment, communicate with the seller etc. Time I could have spent with a seller who understands how Ebay should operate.0 -
I bid £6 on an item with a starting price of 99p, postage £5 and a Buy it Now of £20. The BIN price is very high. £5 to £8 plus £5 postage would be a fair price.
I was the only bidder so of course I won at 99p. I paid immediately. The seller immediately refunded my payment with a message:
“Sorry forgot to take off the bid option, was in a bit of a rush”.
I replied with:
“Hi, I bid and won in good faith. It is not my fault that you had a low starting price or that there were no other bidders.
I will pay again and I expect you to despatch the item in accordance with Ebay terms and conditions.
Thank you”
I paid again but he again immediately refunded with a message:
"I refunded you and gave you a reason therefore I have kept within the conditions"
He relisted the item, this time at £12 and BIN £20.
I know I can’t force him to despatch them and it is a fairly trivial matter but I do want to report him to Ebay for potential fee avoidance with the low starting price and leave the appropriate feedback. I am irritated that my time has been wasted when I could have bought the item from another seller.
What is my best course of action with Ebay?
Can I get his new listing removed as the item belongs to me?
If I leave accurate and non abusive feedback, can he have that removed as technically I now haven’t paid? What is the best wording?

It's a bit moot now and I am not interested in the legal discussion that got in the middle (so apologise if I missed this point in there), but he said he meant only to list it as BIN but then relisted it as another auction; says enough there.Toyota - 'Always a better way', avoid buying Toyota.0 -
Seller had 2 options
- could have listed at the MINIMUM price he expected to pay.
- could have protected it with a reserve.
A NPS and a neg is well deserved. Remember to add him to your blocked bidder list;)
I list items for 99p all the time - why? because I am clearing out and trying to raise money for work in my house and because they are items I might otherwise have taken to the charity shop.
