Hi im wondering if anyone can help, I purchased a used car less than 2 months ago, with a years MOT only 1 advisory. Found a few faults with it so Took car back twice to get it sorted but was still a bit suspicious so got an MOT done which it failed on 9 things which would not just have apeared out of nowhere. I then found out it was previously a Cat C write off, which when I originally asked if it had been they told me no. Am I within my rights to get my money back. They keep trying to fob me off to the garage that did the MOT but I know my deal is with them. Thanks

It depends if you bought it from a dealer or from a private person.
Alos, it depends if the price was a lot cheaper than what similar cars were.0 -
the mot would only be valid on the day of testing anything can go afterwards
if you are sure the second mot tester isnt trying it on then i suggest you contact vosa but best of luck with this approach
as regards the cat c why didnt this show up on the hpi you did as a moneysaving paid up member?0 -
The car was from a dealer and they do an experian car check supposedly, but I guess in this case they didn't. I phoned them asking why they didn't tell me it had previously been a write off and they seemed to just come out with excuses. The car wasn't cheaper than other garages. The new MOT got done at a reputable garage. One of the things originally picked up as an advisory was now picked up as a major fault and they told me to ask for a refund and gave me a vt17 form to send to the ministry. I Also originally pointed out the hand brake had too much travel to which I was told "its OK just stick it in 1st gear when you park". I've opened up a case with trading standards and am currently writing a letter of complaint to the dealer.0
