Help! Lloyds taking me to court and receive land registry forms!?

Can anyone help?

Lloyds tsb are taking me to court over my credit card for £1800, asked the court to consider my case which will cost me £80! I was paying lloyds £20 pm but when I contested the balance as there were charges that they agreed were unfair I didn't pay them as the amount owed was in dispute-this may be an error on my part as assumed the account was on hold as it was being investigated by lloyds? Now they have contacted the land regestry office saying that they want to apply to have it against the house or something? I'm so confused! I have had so many problems with lloyds- they were fraudulently taking money out of my D/C and then charging me for it being returned and then charging me for money not going in! I want to scream at them, years of too-ing and fro-ing and I'm at my wits end. Dnt know what to do? :(

    If this is the county court, you don't have to pay the application fee if you are on certain benefits or (I think) can provide evidence that it would cause you hardship to do so. The court can give you more info.

    The land registry thing sounds like they have obtained a charging order against you. I don't know about credit card debt (different rules in some respects) but with other debt this can only be obtained once they have sent a court claim form to you and entered a county court judgment.

    The best thing I can suggest is to speak to citizens advice bureau (or similar) or a solicitor.

    If you admit that the debt is owed but you just need time to pay, you can apply to the court and they may order you to pay £x per month and, so long as you do, Lloyds will not be able to take further action against you. You will probably still get the charge put against your house though as security for the debt.

    I have 4 different accounts with lloyds and did ask them if I could consoliidate it into 1 and pay it all off together but they ignored my question and sent a generic letter back. With regards to the property I only own a % so can they still secure it? I feel like they are being really unfair with this as the other accounts are being payed monthly at a higher rate and iv told them as soon as they are clear I will move that money to them to pay more. We both work and have a child, we get no benefits but equally dnt have spare cash, dnt go out dnt buy things just what we need! Lloyds know all this and dnt care, they are just greedy, they gave me back my ppi for this account which I cleared my rent arrears with. Lloyds put me in very bad financial hardship for many years and they are trying to ruin my report even more! :mad:

    But Lloyds weren't being unfair really, were they ? They agreed you could pay £20, which you didn't keep up with.

    It sounds as though you need to look at your budget, if you're both working, there may be a few areas you can cut back on to free up some cash to go towards what you owe. How were they taking money from your account fraudulently ? Are you referring to the charges ?

    I'd speak nicely to Lloyds and explain that you're willing to make regular payments, even though you are in dispute with them. Then post a SOA on the Debt Free Wannabee board for more help.

    A charging order can only be obtained if a CCJ or court order is already in place.

    Have Lloyds already obtained the CCJ against you?

    Yes but only against your interest. If you each own 50%, only your 50% will be affected
