Change of terms!

Over the past year I have managed to acquire 3 tickets from a private parking company. Each time I have been over by minutes and it has been because I was held up queuing in the shop. Anyway, when parking in the same car park this week I noticed they have changed the 1 1/2 hours parking to 2 hours.


Whilst I feel it is very unlikely they would take me to court, now that they have changed the time could they prove I went over the allowed time since the letter they sent clearly shows I was under the 2 hours they now allow?

  • It doesnt matter how many hours they "allow", or how often they change it. A scam is a scam, and you won't be going to court.

    If you think that they are really going to take you to court, you need to disabuse yourself of that notion immediately. Stop worrying. These companies always threaten to, but.... they make politicians look truthful.

    Why not buy a nice little folder mark it scammers and place all the junk you get in there ? When you are having a bad day open it up to have a laugh, if you do it while your feet are up with a can of something it will lighten any day ;)
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I am not worried they will take me to court. I was just wondering, if they had any hope in court, how this would now work since according to the present terms I didn't overstay.

    Incidentally with a new Act having been passed regarding the keeper giving info on the driver we may find we can no longer ignore these letters.

    Yes, it is still rather unclear what impact this new law will have. It may well be that we will have to devise a new strategy.

    This may include getting everyone to appeal so as to log-jam the system for years. After all, the PPC is bound by the appeal decision but the driver isn't.

    And the sop to the PPCs may prove worthless. I do not think there is to be any power granted to issue a fine, so the same objection to payment (unlawful penalty) will still apply.

    If it was a real contract then it would be the terms you accepted when you entered into the contract. If they wish to alter terms in a contract you already have with them, they would have to offer you the new terms which you could accept or refuse.

    Like a credit card company you can accept the new terms or you can stay on the old terms but cant borrow any more money, or negotiate!

    However as you never entered into a contract with anyone then it don't really matter what terms they change!
