    If you can afford to pay £10 a month off your debt then do so because after all you borrowed the money in the first place and therefore you should do the decent thing and pay it off.

    You can, and should, write to the Companies involved and ask to see a Copy of your Consumer Credit Agreement. This costs £1 and should be sent by Recorded Delivery.

    Without this information, on a post-April 2007 Account, they can scream and shout all they want.... but they cannot take you to Court !

    Most of what you have been told so far is opinionated rubbish, especially those who say 'you have a moral duty to pay'. If you genuinely are unable to pay, or the Companies involved have screwed up their end of the Contract and have written the Account off by selling it to the scummy world of the DCA ( Lowells etc ) then you should take whatever action you feel you are able to to avoid their money-grabbing tactics.

    I cannot name any particular sources here, but if you Google 'CCA Request', you'll find a Template. This ONLY applies to Accounts started before April 2007 and NOT applied for online though.

    Statute Barred.....six years after last ACKNOWLEDGEMENT OF YOUR LIABILITY, don't phone them!!!!

    Debt Collectors will lie and cheat in every way they can to scare you into paying, even if the Account IS SB. They are not to be trusted.

    From what you say, the Next debt is statute barred already. Just send the SB letter and complain to OFT/FOS if they do not cease collection activity

    Thanks guys! I totally hold my hands up to the moral duty of i should have paid it. I posted my statement of earnings on here before and a smost of you can see i am a part time mother who is surviving on less than £100 per month to live from. I was very stupid in last 10 years, however have spent the last few years being good (have paid off all major loans and big debts, now have no big debt and credit file has improved drastically compared to what it was) However these old old debts that i didn't deal with have come back to haunt me. If i was still working full time and earning £22k then I'd happily pay them off, but for me even £10 a month is a chunk of cash I would miss. Out of the 3 debts i am being chased for the only one I will pay is the credit card debt of £300, as i know i spent that money, but will wait for now until i am pushed to pay (hoping to get some major overtime later in the year for a week which i am planning on paying them off with, just need to keep stalling them).

    Thanks for all your help though. I feel a bit less anxious today if the door goes. If he comes to the door today i might just open letterbox and tell him to contact head office to ask about the letter i sent.

    Oh P.S I contacted my bank yesterday and they can only view statements from 2005 onwards, but there has been no direct debits paid to next on any of the statements they can see, so it was definately pre 2005 when i last made a payment/paid them off.

    If 2005 then definitely Statute Barred by now. :j

    Don't feel you have a moral obligation of any sort with the banks: :(
    1) They would have written off your debt as a loss against taxes years ago
    2) You probably paid them lost of interest while you were paying
    3) Banks have no morals, they don't think about the damage the cause to individuals or the society as a whole, their only purpose is to make money for the bankers and shareholders. :mad: :mad: :mad:
