Reclaiming PPI on closed accounts

Hi All,

Can anyone help? I have recently tried to reclaim mis-sold PPI on an account that was closed more than 6 years ago.

I have the loan agreement documents and the PPI documents which clearly state premium = £15.91 per month for 60 months from the 24th Nov 2001, but I have no other documents.

I have passed these documents onto the HFC bank and have today recieved a reply from HFC.

They say "as the account has been closed for more than 6 years we are unable to review any documents that support your claim. However if you can provide bank statements that can establish the term of the loan and the number of payments made we may be able to investigate further"

What do you think my next step should be, I have proof I was sold PPI for 60 months but I can't prove I paid it.

P.S. They also said I have 28 days to respond. is this correct?

  • If you know who the payment are made to then apply to them for a copy of a statement from beginning to end and ask for all appropriate dates to they have to supply it. That is so long as they have not gone bump. I am in the same situation my mortgage finished with Northern Rock 8 years ago but I stupidly kept the PPI going only to find out that because my job would pay out redundancy it won't pay out.

    The only way you can prove that you paid this PPI is bank statements I am afraid, they will not consider the documents you have because this PPI could have been cancelled in the first 30 days or you settled this loan early, they need to know exactly what was paid so they can redress correctly if this PPI was mis sold.

    Have you no statements from just before the loan was finished?, you could ask the bank you paid this loan from how far back they keep statements for, but this is a long shot and if they can get you any they will make a charge for this and it could be per statement, give the bank a ring and ask if they can help.

    I have followed this site & done my letter for terms & conditions & credit agreement on my credit cards & loans, not a word do I understand of it, there are no details of my loans just terms & conditions, why do you have to ask for this I don't know if I've been missold & don't want to pay companies who charge 30% but haven't got a clue what to do with the stuff they sent gives nothing away, also M&S have charged Insurance Premium Tax on my loans from 2002, what is this? what do I next?

    I have Microsoft money on my PC I have searched through archives of old accounts and found I do have records of payments to HFC at that time however only up until Oct 2003. would this be acceptable as evidence?

    You could send copies of the statements you have and explain that these are all you can find, they may look at the claim and if you were mis sold they may redress for the statements you have and not the full PPI.

    This is very mis leading asking for terms and conditions, this info should be changed on the forum.
    If you have a loan number, your Credit card number and reasons for mis sell then you just put the claim in.

    If you have no paperwork at all then contact the banks in question and ask if they can find you, if they cannot find you then you need to send a Sar request to the banks ( one Sar for one bank even if you had CC and loans with them) the cost is £10 per bank except for Natwest who do not charge for this, you ask for ALL info they hold on you and give them 40 days to respond, give as much info as you can to help them find your accounts Dob address etc if you do not have the account number, if these loans and CC were closed more than 6 years ago it is possible they may not find your accounts so be prepared for that although people on this site have had Sar info from a great number of years before the 6 limit, this depends on the bank and how they archive and destroy Data.

    The terms and conditions let you see what you were covered for and if any were not relevant to you then these are reasons you can use for mis sell.
    If you have a loan number, your Credit card number and reasons for mis sell then you just put the claim in.
